Streamlining administrative procedures for investors through the application of special investment procedure

Within the scope of the Law on Investment 2020 amended in 2024, Article 36a has been updated to stipulate the groups of investment projects that are eligible for registering under special procedure upon satisfaction of specific conditions. Accordingly, from January 15, 2025, investors implementing projects regulated by the new procedure will be entitled to more preferential policies as many licenses and administrative procedures related to investment policy approval, environment, construction planning, fire prevention and fighting, and a number of other procedures under law are eliminated. In order to provide specific guidance on the implementation of the above regulations, Decree 19/2025/ND-CP detailing the Law on Investment regarding special investment procedures was issued and effective from February 10, 2025.
Amendments to regulations on environmental impact assessment – Some effects on investment project owners

On January 6, 2025, the Government promulgated Decree 05/2025/ND-CP amending and supplementing several articles of Decree 08/2022/ND-CP dated January 10, 2022 on elaboration of certain articles of the Law on Environmental Protection 2020 (Decree 05). Decree 05 took effect on January 6, 2025 with several amended and supplemented regulations related to environmental impact assessment.
Some new regulations on information disclosure and report on corporate bond offering and trading

On November 6, 2024, the Minister of Finance issued Circular 76/2024/TT-BTC guiding the information disclosure and report on offering and trading privately-placed corporate bonds in the domestic market and offering corporate bonds to the international market.
New regulations in the Circular on sanctions for administrative violations in industrial property

On September 30, 2024, Circular 06/2024/TT-BKHCN was issued by the Ministry of Science and Technology to amend and supplement Circular 11/2015/TT-BKHCN providing guidelines for Decree 99/2013/ND-CP on administrative sanctions in industrial property.
New regulations on trade promotion activities

On October 10, 2024, the Government issued Decree 128/2024/ND-CP (Decree 128) amending and supplementing some articles of Decree 81/2018/ND-CP which provides details for the Commercial Law on trade promotion activities. Decree 128 shall take effect on December 1, 2024.
Notable contents in the Draft Law on Personal Data Protection

The implementation of Decree 13/2023/ND-CP on personal data protection has revealed a need for a specialized law on personal data protection to ensure consistency with domestic laws as well as compatibility with international laws and practices. To meet these requirements, the Ministry of Public Security has developed a Proposal for a Law on Personal Data Protection.
