What enterprises need to know about the new guidance on fire prevention and fighting under Decree 347/2026/ND-CP?

On September 8, 2026, the Government issued Decree 347/2026/ND-CP amending several Government Decrees, including Decree 105/2025/ND-CP detailing a number of articles of, and measures for implementing, the Law on Fire Prevention and Fighting, Rescue and Salvage, and Decree 106/2025/ND-CP providing for sanctions for administrative violations in the field of fire prevention and fighting, and rescue and salvage (Decree 347). Decree 347, which comes into force on September 15, 2026, aims to establish a consistent and unified legal basis in line with the applicable legal documents and to reduce and simplify administrative procedures to support citizens and businesses.

Decree 69/2026/ND-CP: Notable changes to administrative sanctions in the field of fire prevention and fighting

To enhance compliance in the field of fire prevention and fighting, rescue and salvage, and to ensure consistency with the applicable legal framework on fire prevention and fighting, rescue and salvage, on March 6, 2025, the Prime Minister issued Decree 69/2026/ND-CP amending and supplementing a number of provisions of Decree 106/2025/ND-CP on administrative sanctions in this field.

Increasing fines for administrative violations related to fire prevention and fighting

To raise awareness in fire prevention and fighting, increase deterrent effects to prevent and minimize violations of fire prevention and fighting, on May 15, 2025, the Government issued Decree 106/2025/ND-CP regulating administrative sanctions against violations in the field of fire prevention and fighting, rescue and salvage, replacing Decree 144/2021/ND-CP regulating administrative sanctions against violations in the field of security, order and social safety; prevention and control of social evils; fire prevention and fighting; rescue and salvage; prevention and control of domestic violence.

Some new regulations on fire prevention and fighting of enterprises

On July 10, 2024, the Ministry of Public Security issued Circular 32/2024/TT-BCA amending Circular 149/2020/TT-BCA guiding the Law on Fire Prevention and Fighting; the amended Law on Fire Prevention and Fighting; and Decree 136/2020/ND-CP guiding the Law on Fire Prevention and Fighting and the amended Law on Fire Prevention and Fighting; and Circular 08/2018/TT-BCA guiding Decree 83/2017/ND-CP regulating rescue work of the fire prevention and fighting forces.

On May 10, 2024, the Government issued Decree 50/2024/ND-CP amending Decree 136/2020/ND-CP guiding the Law on Fire prevention and fighting and the Law on Fire prevention and fighting (amended) and Decree 83/2017/ND-CP regulating the rescue work of fire protection and prevention forces.
