Change in authority: Note to employers when carrying out labor and employment-related procedures

On June 11, 2025, the Government issued Decree 129/2025/ND-CP regulating the delimitation of the competence of local governments at 02 levels in the field of state management of the Ministry of Home Affairs. Decree 129 takes effect from July 1, 2025 and stipulates changes in the authority to settle a number of administrative procedures in the field of labor and employment
Some issues to be noted by enterprises from the draft Decree guiding compulsory social insurance

After consulting ministries, sectors and localities and appraisal opinions of the Ministry of Justice, the Ministry of Labor, Invalids and Social Affairs (now merged into the Ministry of Home Affairs) has submitted to the Government a draft Decree detailing and guiding the implementation of a number of articles of the Law on Social Insurance on compulsory social insurance, with some outstanding contents of the Draft Decree that enterprises need to pay attention to.
Highlights of the Law on Health Insurance 2024

Participating in health insurance is one of the fundamental rights of citizens, which has been stipulated in the Law on Health Insurance 2008 and its guiding documents. However, after 15 years of implementation, the Law on Health Insurance 2008 has revealed certain limitations and shortcomings. As a result, on November 27, 2024, the National Assembly issued Law No. 51/2024/QH15 to amend and supplement several provisions of the Law on Health Insurance 2008 (Law on Health Insurance 2024).
New regulations of Law on Trade Union 2024

On November 27, 2024, the National Assembly promulgated the Law on Trade Union No. 50/2024/QH15, replacing the Law on Trade Union 2012 (Law on Trade Union 2024). This Law is promulgated to overcome the limitations and inadequacies of the Law on Trade Union 2012 after more than 10 years of implementation, such as: some matters regarding the organizational system, financial mechanism, trade union rights, etc.. In addition, the Law on Trade Union 2024 aims to institutionalize the Constitution 2013, policies and resolutions of the Party and ensure the consistency of the legal system. The Law on Trade Union 2024 will take effect from July 1, 2025.
Some new points in the Draft Law on Health Insurance

In order to perfect the regulations on health insurance in accordance with the Party's policies and orientations, in line with the practice and the compatibility with the health insurance laws of other countries, the Ministry of Health is drafting a Law amending and supplementing a number of articles of the Law on Health Insurance.
New regulations on statutory minimum wages paid to employees working under labor contracts

On June 30, 2024, the Government promulgated Decree 74/2024/ND-CP prescribing statutory minimum wages paid to employees working under labor contracts, thereby changing the regulations on the hourly and monthly statutory minimum wages, at the same time, readjusted some areas applying the minimum wage according to Regions I, II, III, IV Upon its effectiveness, Decree 74/2024/ND-CP will replace the previous Decree 38/2022/ND-CP prescribing statutory minimum wages paid to employees working under labor contracts.
