The Law on Intellectual Property is being amended and supplemented (the Draft IP Law) to overcome several problems arising in practice, ensuring conformity to the current science and technology development and meeting the commitments under the international treaties Viet Nam has engaged in. NHQuang has analyzed some outstanding contents of the latest Draft IP Law. The content of the article includes 04 (four) main parts:
- Supplementing the provision that sound can be registered as a trademark;
- Supplementing the circumstance of trademark certificate invalidation if trademarks become generic term;
- Providing a separate provision on mechanism for opposition against industrial property registration applications;
- Supplementing the “bad faith” element to the act of unfair competition related to domain names.
