Abstract:
In response to the context of increasing vulnerability to climate change and the challenges faced by environmentally affected individuals and communities in Viet Nam, especially relating to environment-related tort damage compensation, the United Nations Development Programme (UNDP), in collaboration with the Ministry of Justice, conducts the Legal study on International experiences to improve the efficiency of environment-related tort damage dispute resolution. The goal is to enhance the efficiency of environmental-related tort damage dispute resolution in Viet Nam by learning from international law and other countries’ experience, thereby enhancing the sustainability of environmental justice efforts within the country.
The Study analyzes both cases of environment-related tort damage compensation in the applicable legal system, including: (i) Claims for compensation for damage caused by impairment of environmental function and usefulness (the State is the requesting party); and (ii) Claims for compensation for damage to human life, health and property (between organizations and individuals in the private sector). This Study is significantly meaningful for the work of law development because it is one of systematic studies on environment-related tort damage compensation since the Law on Environmental Protection 2020 was promulgated and took effect, conducted from a comparative perspective with international law and the laws of other countries to have an objective and multidimensional view, thereby making useful recommendations, and solutions to improve the effectiveness of environment-related tort damage dispute compensation resolution in Viet Nam.
