On August 23, 2023, the Government promulgated Decree 65/2023/ND-CP providing details for several provisions and measures for implementation of the Law on Intellectual Property on industrial property, protection of industrial property rights, rights to plant varieties, and state management of intellectual property. This Decree takes effect from the signing date with the following highlights about the procedure of establishing industrial property rights:
(i) Amending and supplementing regulations related to registration application forms;
(ii) Amending and supplementing the registration application form for IPR establishment;
(iii) Splitting applications for IPR establishment;
(iv) Detailing the conditions for restricting the transfer of trademark rights under Clause 4, Article 139, Law on Intellectual Property 2005, amended and supplemented in 2022.
