Abstract:
The operation of the courts plays an important role in economic and social development, as reflected in their role in interpreting market principles and rules, and protecting economic rights. In recent years, the proportion of enterprises involved in contractual disputes has been on the rise, seemingly proportional to the growth of the market and economy. However, surveys conducted by both Vietnamese and international organizations on enterprises in Viet Nam show a declining tendency among businesses to use court services to protect their contracts.
At the same time, in recent years, the Communist Party, the Government of Viet Nam, and the Supreme People’s Court have introduced macro-level policies to reform the judicial sector, aiming to better safeguard the rights of citizens and businesses. To turn these policies into reality, the court sector has taken specific and decisive actions from central to local levels to help make Viet Nam’s economy more competitive globally and contribute to building the rule of law in the country.
In support of the implementation of Government Resolution 19 on improving the business environment in Viet Nam, the Governance for Inclusive Growth Project of the United States Agency for International Development (USAID) collaborated with Mr. Nguyen Hung Quang – NHQuang&Associates to conduct a study entitled “The Aspiration of Enterprises Towards Courts’ Activities in Enforcing Contracts”. The report applies the methodology of the World Bank’s Doing Business report, analyzing court operations from the perspective of businesses in relation to contract enforcement. It identifies several shortcomings that need to be addressed in order to make court operations more effective and business-friendly, thereby contributing to Viet Nam’s economic development.
This report is the outcome of research on Viet Nam’s business environment carried out within the framework of the USAID Governance for Inclusive Growth Project.
