Abstract:
The Judicial Reform Strategy to 2020 identified that “Courts have a central role, and adjudication is the core activity.” Judicial reform efforts have been centered around the structure and operations of the court system. Within this framework, court administration has emerged as a crucial issue in the restructuring and operational mechanisms of the court system. Although the Central Steering Committee on Judicial Reform has assigned the Supreme People’s Court and other central judicial agencies to study various proposals within the scope of judicial reform, by 2014, there had yet to be any proposal that conducted an in-depth and comprehensive study on court administration.

Against this backdrop, the Project on Strengthening Access to Justice and Protection of Rights in Vietnam, a collaboration between the Government of Vietnam and the United Nations Development Programme (UNDP), supported the implementation of the Survey Report on the Status of Administrative Management of Local People’s Courts in Vietnam. This study aimed to examine the internal functional and task-based relationships within the court system and within individual court units, in line with the goals of judicial reform.

The Report analyzes four main areas:

Part I: Judicial Administrative Management at the Courts
Part II: Court Governance
Part III: Key Factors Affecting the Relationship Between Court Administrative Management and Court Governance
Part IV: Selected Reform Issues for the Future

Each part includes both an analysis of relevant legal provisions and the presentation of survey results conducted at 63 provincial-level People’s Courts and 697 district-level People’s Courts, with a relatively high individual judge response rate. Based on this, the report proposes a number of solutions aimed at reforming Vietnam’s judicial administration system.
