2015 Justice Index – Towards a justice system for the people

The report recommends focusing on improving the performance of local judicial agencies and promoting the development of the legal profession and other justice-supporting mechanisms. It also suggests using the Index as a tool to monitor and evaluate the implementation of national action programs aimed at fulfilling Vietnam’s commitments to the Sustainable Development Goals under the 2030 Agenda.

Based on a questionnaire survey and in-depth interviews, the report focuses on identifying issues lawyers face in applying Circular 70 and the Coordination Regulation, from these findings, the report proposes recommendations to improve the legal framework governing the right to defense.

Appointed councels in Vietnamese criminal laws and practice

The right to legal defense is one of the fundamental human rights, recognized in the International Covenant on Civil and Political Rights (ICCPR). This right includes both the “right to active legal defense” and the “right to mandatory legal defense.” The latter not only refers to the right of the accused/suspect/detainee but also imposes a duty on the prosecuting authorities to ensure legal defense is provided. Vietnamese criminal law has provisions to guarantee this right to mandatory legal defense.
