On June 8, 2023, the Ministry of Finance promulgated Circular 38/2023/TT-BTC on the collection rate, regime of collection, payment, management and use of the fees for appraisal of environmental impact assessment reports by central agencies to replace Circular 56/2018/TT-BTC. Circular 38 takes effect from August 1, 2023.

On April 3, 2023, Decree 10/2023/ND-CP (Decree 10) was issued to amend and supplement several articles of Decrees providing guidelines for implementation of the Law on Land, which will take effect from May 20, 2023. Decree 10 introduces notable amendments and supplements regarding investment projects regulated by Decree 43/2014/ND-CP, as amended and supplemented by Decree 01/2017/ND-CP.

In order to provide the penalties compatible with the provisions of the Law on Environmental Protection 2020, Decree 08/2022/ND-CP and Decree 06/2022/ND-CP, the Government has issued Decree 45/2022/ND-CP on penalties for administrative violations in the field of environmental protection, taking effective from August 25, 2022.

In order to provide the penalties compatible with the provisions of the Law on Environmental Protection 2020 and the Decree guiding the Law on Environmental Protection 2020 (currently in the drafting stage), the Government has published a Draft Decree on penalties for administrative violations in the field of environmental protection.

On May 21, 2021, the Government issued Decree 54/2021/ND-CP on preliminary environmental impact assessment to replace Article 12 of Decree 40/2020/ND-CP. This Decree came into force from the date of signing.

In order to concretize some provisions of the Law on Environmental Protection 2020 (LEP 2020) approved by the National Assembly on November 17, 2020, the Government is drafting a Draft Decree providing details for some articles of this law (Draft Decree). So far, the collection of comments from concerned experts and agencies to complete the contents of these regulations has finished.
