Abstract:

The Vietnamese Judiciary: The Politics of Appointment and The Vietnamese Judiciary: The Politics of Appointment and Promotion is a joint research project by Professor Pip Nicholson and Lawyer Nguyen Hung Quang, initiated in 2002 and published in 2005. The study reviews the historical development of Vietnam’s court system to examine the origins of institutional mechanisms for the selection, appointment, rotation, reward, and discipline of judges, as prescribed under the Law on the Organization of the People’s Courts of 1992 and 2002, as well as the Ordinance on Judges and People’s Jurors during the same period.

Based on these legal provisions, the study finds that these institutional mechanisms have had a significant impact on the integrity and independence of judges. It argues that if Vietnam aims to improve the quality and independence of its judiciary, reforms are needed in the systems of judicial selection, appointment, rotation, reward, and discipline. The research was published in the Pacific Rim Law & Policy Journal of the University of Washington.
