Abstract:
“Legal Profession and Legal Reforms in Vietnam” is a paper by Lawyer Nguyen Hung Quang presented at the Law and Development in China and Vietnam conference, organized by the National University of Singapore in 2016. The conference brought together scholars from Vietnam and China to examine the similarities and differences in legal, economic, and political development between the two countries. The study provides an overview of the historical development of the legal profession in Vietnam to identify differences in perceptions of the role of lawyers in society. It shows that the development of the legal profession in Vietnam is closely tied to the evolution of the Vietnamese judiciary, particularly in two aspects: independence and professional quality.
The research also finds that, in the context of international integration, legal practice in Vietnam has seen significant growth in terms of independence and professionalism. This growth has been driven by both objective and subjective factors, such as the practical demands of international commercial activities and the political pressure for economic integration in Vietnam, which has led to more openness from state agencies toward lawyers’ activities. However, the study also points out that legal practice in other areas still faces many challenges and remains closely linked to the development of judicial institutions in Vietnam.
The research suggests that if Vietnam aspires to build a rule-of-law state, greater improvements are needed in the independence and professionalism of the legal profession.
