Some new points in the Draft of Law on Employment

The Law on Employment 2013 is the first law that fully and comprehensively regulates the employment relationships and labor market in Viet Nam. However, after over nine years of implementation, the Law on Employment 2013 has shown several inadequacies that are no longer suitable for the current practice and socio-economic context. Therefore, the Ministry of Labour – Invalids and Social Affairs is developing a Draft of Law on Employment (amended) (Draft Law) to implement new orientation and policies of the Party, ensure the synchronization, consistency, and suitability of the legal system and international commitments that Viet Nam participates in. This article introduces some outstanding new points of the Draft Law, focusing on the regulations related to unemployment insurance (regarding subjects of unemployment insurance engagement and payable unemployment insurance rates) and labor registration.

New regulations on unemployment insurance

The Ministry of Labour – Invalids and Social Affairs issued Circular 15/2023/TT-BLDTBXH amending, supplementing some provisions of Circular 28/2015/TT-BLDTBXH providing guidelines for Article 52 of the Law on Employment and Decree 28/2015/ND-CP providing guidelines for the Law on Employment in terms of unemployment insurance (Circular 15). Circular 15, taking effect from February 15, 2024, provides some notable contents related to unemployment insurance.

New contents of the Circular guiding compulsory insurance in construction investment

On August 11, 2022, the Ministry of Finance promulgated Circular 50/2022/TT-BTC guiding Decree 119/2015/ND-CP on compulsory insurance in construction investment and Decree 20/2022/ND-CP amending Decree 119/2015/ND-CP regulating compulsory insurance in construction investment. This Circular takes effect from October 1, 2022 and replaces Circular 329/2016/TT-BTC guiding the implementation of Decree 119/2015/ND-CP regulating compulsory insurance in construction investment activities.

Regulations on regimes for employees suffering from occupational accidents and diseases

On December 28, 2021, the Ministry of Labor, Invalids, and Social Affairs issued Circular 28/2021/TT-BLDTBXH providing details and guidelines for implementation of the Law on Occupational Safety and Hygiene in terms of regimes for employees suffering from occupational accidents and diseases. Some noticeable features of this Circular are presented in this article.

New regulations guiding implementation of some articles of the Social Insurance Law on compulsory social insurance

On July 7, 2021, the Ministry of Labor, War Invalids and Social Affairs issued Circular 06/2021/TT-BLDTBXH amending Circular 59/2015/TT-BLDTBXH guiding the implementation of some articles of the Social Insurance Law on compulsory social insurance.
