Legal study on International experiences to improve the efficiency of environment-related tort damage dispute resolution

This Study is to enhance the efficiency of environmental-related tort damage dispute resolution in Viet Nam by learning from international law and other countries’ experience, thereby enhancing the sustainability of environmental justice efforts within the country.

Outstanding points on sea encroachment activities

On April 16, 2024, the Government issued Decree No. 42/2024/ND-CP providing detailed regulations on sea encroachment activities (Decree 42). This Decree is formulated and promulgated with the aim of providing detailed guidelines for Article 190 of the Law on Land 2024 and applies to agencies, organizations, and individuals involved in sea encroachment activities, except for activities serving national defense and security purposes.

Notable provisions of the Decree on penalties for administrative violations in the field of environment

In order to provide the penalties compatible with the provisions of the Law on Environmental Protection 2020, Decree 08/2022/ND-CP and Decree 06/2022/ND-CP, the Government has issued Decree 45/2022/ND-CP on penalties for administrative violations in the field of environmental protection, taking effective from August 25, 2022.

Some new points of the Law on Environmental Protection 2020

After more than 5 years of implementation, besides the contributions in creating positive changes in environmental protection, the LEP 2014 has also revealed deficiencies, shortcomings and overlaps with other legal provisions, etc. To overcome the limitations of LEP 2014 and generate new mechanisms in environmental protection, the LEP 2020 was approved by the National Assembly on November 17, 2020. This article analyzes some new points of the Law on Environmental Protection 2020 that can directly impact businesses.
