The “Formative Evaluation of Family and Juvenile Courts in Viet Nam” was conducted by NHQuang&Associates, a Viet Nam-based law firm, commissioned by UNICEF under the framework of the EU Justice and Legal Empowerment Programme in Viet Nam (EU JULE), funded by the European Union with financial contributions from UNICEF and the United Nations Development Programme (UNDP).

Abstract:
Minors/juveniles come into contact with the law for various reasons – as victims or witnesses of crimes, as defendants in criminal proceedings, or as parties in civil proceedings that encompass child protection and custody. Despite the significant number of minors participating in legal proceedings, like most countries, Viet Nam has a court system designed primarily for adults. Moreover, Viet Nam does not yet have a specific law on justice for minors.

This “Formative Evaluation of Family and Juvenile Courts in Viet Nam” focuses on evaluating the establishment and operations of F&JCs – a specialized institution to strengthen justice for minors within the current legal framework through the criteria of relevance, effectiveness, efficiency, and scalability/sustainability, highlighting achievements and barriers, and proposes ways to further promote F&JCs as part of broader legal and judicial reform in Viet Nam. The study was conducted in the context of a Supreme People’s Court (SPC) legislative initiative to develop a specialist law on justice for minors. As such, this report is expected to provide key inputs to inform this development process, especially in strengthening and perfecting the institution of F&JCs.
